Foreign Workers Employment Pass in Malaysia
Foreign workers who have been employed in Malaysia through an Employment Pass must now have new rules in their stay in the country. The Malaysian Immigration Department has introduced a new policy that requires all employers to submit a “change of category letter” to obtain approval for the change of Employment Pass category by foreign nationals.
Changes In Employment Pass Category Application Process
As stated in the new rule or processing, the employer or company has to cancel the existing one Employment Pass first before they could apply for a change of category ( for example Category 1, 2, or 3). Also, starting January 1, 2025, they would then have to submit a “change of category letter” also in the approval stage of application.
What Is an Employment Pass?
The Employment Pass (EP) is a work permit enabling expatriates to be employed with a company in Malaysia. Tied to the employment agreement, which can be for a period of up to 60 months, the employment pass holder may then apply for a dependent pass for their spouse and children under the age of 18.
Work Restrictions and Changes To Company
Foreign workers may only work for the company named on their Employment Pass. They will need to apply for a new Employment Pass when they change employers.
Eligibility in Applying Employment Pass
Before applying for an Employment Pass for foreign workers, ensure that the employee is eligible to apply. For the Immigration Department to issue the Employment Pass, the foreign worker’s employment to the specified position must be approved by the Expatriate Committee (EC) or other relevant authorities.
